Now Kosovo is declaring its independence in a few days or weeks. This will provoke a strong reaction by nationalist Serbians. The US and EU are in favor of Kosovo's independence, but Russia is not. NATO's forces are going to be replaced by EU troops. EU in effect is bribing Serbian leadership to not fight Kosovo's independence. Serbian people will be deciding whether to be cut off from their Christian heritage and go under the EU hand or stay independent. A runoff election will be held at the beginning of February pitting a nationalist leader against one led by the nose by the EU and US.

The information appears to be nearly identical on both sites, so I will get busy trying to find additional sources but I wanted to post this comment now to hear what others have to say.
Constitutional Law is certainly not my specialty, but the relevant Supreme Court decisions are noted on both web pages. It appears that, “No Executive Order, Presidential Directive, Executive Agreement, no NAFTA, GATT/WTO agreement/treaty, passed by ANYONE, can supersede the Constitution.”
In order for this to happen the President would need to suspend the Constitution, something that is not beyond the realm of possibilities as you have noted. And the only way this can be accomplished is if We the People, are convinced of some big lie and allow it to happen.
With the recent Republican drop outs providing fuel for my disappointment, strict Constitutionalist Ron Paul has moved up yet another notch in my Presidential poll. Fat chance he will be elected though, especially if the citizens of this country fail to wake up in time.

Real ID, National Drivers License Requirements and WA enhanced drivers license
There seems to be much confusion surrounding the Real ID and its requirements, I thought I would take a look and see what was happening in my state. I know this will not affect everyone on this board, but you can see how far it has come already.
Here is a compilation of articles that describe it, some are pro and some are con. It appears to me in a cursory scanning of all the documents, that Washington State has passed a bill stating its objections to the Real ID act. Because they have not filed an official waiver with the Department of Homeland security, the requirements of Real ID will apply to us starting in May of 2008. If Washington changes its position and says it will comply, they will have an extended deadline. What that will mean to WA residents, is that your State issued ID will no longer be valid ID for boarding a Federal regulated aircraft in the US, opening a bank account (including investments I think) and entering any Federal facility (I guess that means the post office too). You will however, be able to use a passport if you have one.
However, Washington State has decided to offer an enhanced drivers license, which actually goes above and beyond the Real ID rules, but since they have not filed the waiver, it is unclear if getting an enhanced ID is Real ID compliant. I have provided links for all the applicable articles for you. The enhanced drivers license has an RFID tag embedded into it, and it appears that they will be compelled by Federal Law to submit its drivers license database to Canada and Mexico and to other states for cross referencing or risk losing their federal funding.
**One Note*** on the Wikipedia article, it has changed considerably since the last time I viewed it, and some of the information that I have on my previously printed copy is much different. Just use it for reference.

This would assume equivalence. However, there is a massive amount of text, articles, court decisions, opinions all declaring that treaties are valid only if they do not conflict with the Constitution, (or until they cause us a problem down the road).
The Reid Court (U.S. Supreme Court) held in their Opinion that,
"... No agreement with a foreign nation can confer power on the Congress, or any other branch of government, which is free from the restraints of the Constitution. Article VI, the Supremacy clause of the Constitution declares, "This Constitution and the Laws of the United States which shall be made in pursuance thereof; and all the Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme law of the land...’
"There is nothing in this language which intimates that treaties and laws enacted pursuant to them do not have to comply with the provisions of the Constitution nor is there anything in the debates which accompanied the drafting and ratification which even suggest such a result...
"It would be manifestly contrary to the objectives of those who created the Constitution, as well as those who were responsible for the Bill of Rights – let alone alien to our entire constitutional history and tradition – to construe Article VI as permitting the United States to exercise power UNDER an international agreement, without observing constitutional prohibitions. I would ask you to consider the long trail of broken treaties the Federal Government has authorized with First Nations people (Native Americans) which were later ignored or discarded as a matter of convenience. Treaties are honored mostly out of convenience, when it benefits both parties, and only have the power we are willing to give them, or give up.

We are getting taste of that now. On an international scale we are to be patient with suicide bombers, those who behead others, burn cars by the thousands, or who run terrorist camps, and we are told real crimes are thought crimes, verbal crimes or in any way offending those labeled easily offended by the government.

Constance, I do not agree with the comment you made near the end of today’s Micro Effect broadcast where you said, “treaties take precedence over the United States Constitution.” That appears to be a fallacy that certain power brokers would love us to swallow. The information appears to be nearly identical on both sites, so I will get busy trying to find additional sources but I wanted to post this comment now to hear what others have to say.
Constitutional Law is certainly not my specialty, but the relevant Supreme Court decisions are noted on both web pages. It appears that, “No Executive Order, Presidential Directive, Executive Agreement, no NAFTA, GATT/WTO agreement/treaty, passed by ANYONE, can supersede the Constitution.”
In order for this to happen the President would need to suspend the Constitution, something that is not beyond the realm of possibilities as you have noted. And the only way this can be accomplished is if We the People, are convinced of some big lie and allow it to happen.
With the recent Republican drop outs providing fuel for my disappointment, strict Constitutionalist Ron Paul has moved up yet another notch in my Presidential poll. Fat chance he will be elected though, especially if the citizens of this country fail to wake up in time.

Real ID, National Drivers License Requirements and WA enhanced drivers license
ReplyDeleteThere seems to be much confusion surrounding the Real ID and its requirements, I thought I would take a look and see what was happening in my state. I know this will not affect everyone on this board, but you can see how far it has come already.
Here is a compilation of articles that describe it, some are pro and some are con. It appears to me in a cursory scanning of all the documents, that Washington State has passed a bill stating its objections to the Real ID act. Because they have not filed an official waiver with the Department of Homeland security, the requirements of Real ID will apply to us starting in May of
2008. If Washington changes its position and says it will comply, they will have an extended deadline. What that will mean to WA residents, is that your State issued ID will no longer be valid ID for boarding a Federal regulated aircraft in the US, opening a bank account (including investments I think) and entering any Federal facility (I guess that means the post office too). You will however, be able to use a passport if you have one.
However, Washington State has decided to offer an enhanced drivers license, which actually goes above and beyond the Real ID rules, but since they have not filed the waiver, it is unclear if getting an enhanced ID is Real ID compliant. I have provided links for all the applicable articles for you. The enhanced drivers license has an RFID tag embedded into it, and it appears that they will be compelled by Federal Law to submit its drivers license database to Canada and Mexico and to other states for cross referencing or risk losing their federal funding.

This would assume equivalence. However, there is a massive amount of text, articles, court decisions, opinions all declaring that treaties are valid only if they do not conflict with the Constitution, (or until they cause us a problem down the road).
The Reid Court (U.S. Supreme Court) held in their Opinion that,
"... No agreement with a foreign nation can confer power on the Congress, or any other branch of government, which is free from the restraints of the Constitution. Article VI, the Supremacy clause of the Constitution declares, "This Constitution and the Laws of the United States which shall be made in pursuance thereof; and all the Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme law of the land...’
"There is nothing in this language which intimates that treaties and laws enacted pursuant to them do not have to comply with the provisions of the Constitution nor is there anything in the debates which accompanied the drafting and ratification which even suggest such a result...
"It would be manifestly contrary to the objectives of those who created the Constitution, as well as those who were responsible for the Bill of Rights – let alone alien to our entire constitutional history and tradition – to construe Article VI as permitting the United States to exercise power UNDER an international agreement, without observing constitutional prohibitions. I would ask you to consider the long trail of broken treaties the Federal Government has authorized with First Nations people (Native Americans) which were later ignored or discarded as a matter of convenience. Treaties are honored mostly out of convenience, when it benefits both parties, and only have the power we are willing to give them, or give up.
