So Much Happening in the World -- and in our personal lives as well


Dear Reader:  I dashed this piece off last night at about 3:30 a,.m.  Reading it to my friend Lana today, I discovered it needed editing which has been made below.  Please excuse the less than perfect proofreading.  There may be more that needs to be grammar correected.  My vision issues are kicking in again for this evening.

So Much Happening in the World -- and in our personal lives as well

We have a neighborhood Bible study that was organized a few months ago by our next door neighbor.  During the pandemic, this group has been a comfort to us as churches have been made largely inaccessible.  We are going through the Bible, book by book.  My disabled husband always gives me his blessings and sends me off to it, cautioning me to be on time.  We open and close with prayer.   I pretty much know my Bible cold, but as our study leader (a community college teacher) gives weekly reading assignments, I find re-reading the Bible  makes it much more familiar.  We just finished the book of 2nd Samuel and will be reading and discussing 1 Kings next week, God willing.  We end with refreshments that all participants bring.  Good study and good fellowship!

I returned home from it Sunday afternoon and my husband was in his adjustable large lazy-boy type chair.  Usually when I return, we begin a lively discussion of who was present and what was gleaned from this week's readings.  I started talking before entering the family room.  Barry was uncharacteristically quiet.   I was startled to find him in his chair, clutching a pole lamp that appeared to be falling and unresponsive.  I made a quick decision to call 911 and our Fire Department came thankfully, very very quickly.  A shot was administered and then we gave him a glass of orange juice.  His blood sugar was dangerously low.  He was transported by ambulance to the hospital where his cardiologist practices.  Because of my wet type macular degeneration, night driving is now out of the question for me.  The Fire Department ambulance personnel suggested I wait to hear from the hospital rather than follow them there.  

I then called one of my very loyal friends, Lana Mangiapane, who is also an elected Oakland Township Trustee.  She came immediately and drove me to the hospital.  Because of the Covid-19 rules, only one could enter.  I was taken by a speedy wheel chair pusher attendant to my husband's room in the Emergency section.  Tests were being run and he was given food.  As you may recall, Barry, my husband for the past 46 years is a bilateral above the knee amputee from an October 15, 1979 accident, occurring only five years past our marriage.  With the grace of God, we have lived through that situation since.  Barry has been a real trouper since that accident.  He, a former teacher, took a second MSW degree and took a new post- accident career as a substance abuse therapist/social worker.  He retired a few years ago.  He recently turned 82 -- making his post-accident recovery accomplishments even more remarkable.  Over the years, he drove a car with hand controls and we even managed a few trips together in earlier years.

Time marches on.  The times have clearly turned very strange.  Very few people now saying things such as "lo, all continues as since Creation."  The world is being prepared for a global reset.  Covid-19 is the claimed excuse.  We are, as they like to say "in a time of transition."

I wrote about "our coming age of Barbarism."  That was brought home to me by last night's events.  I was forced to fight for my husband's needed treatment.  Barry's body is weakening.  Transitioning from wheel chair to bed and showering and bathroom are becoming increasingly difficult for him.  He has had continual pain from the accident and has learned to live with it over the years.  Heart trouble set in for him in the early 21st century years, but a defibrillator and pace maker have been successfully employed.

As Lana was driving home on the Freeway, I received a type of "robocall" on my mobile phone.  It was  from the hospital.  This was the same hospital system for which in earlier years I received a restraining order from a local court.  The order which I sought and obtained on an emergency basis prevented them  "pulling the plug" against family wishes on a gentleman whose life they had written off as unworthy of living.  Family members employed me to fight after that hospital told them they were going to pull the plug on his ventilator.   The gentleman had been weakened for many days by the hospital giving him only a drug called Ativan and depriving him of nutrients.  

Preparing for the emergency hearing scheduled by the Court to take place soon after the restraining order was issued, I discovered that hospital attorneys were giving seminars on how to persuade families to make end of life decisions for family members against their wishes.  That hospital's medical and administrative staff were making triage type "quality of life" decisions.  They were giving that gentleman only Ativan.   and depriving him of necessary life sustaining nutrients.   He had lost the ability to speak because of a bad intubation received from a feeder hospital.  Family members approached me after the hospital made demands that they designate a guardian who could authorize the life support ending.  

As I was to learn when I got into that case on an emergency basis, interesting dynamics developed.  As I was to learn when we got into hospital records discovery, the hospital had assigned staff Social Workers to work with family members twice a week with sessions to explore "why won't they let go of Dad."  Then they successfully pressured the family member appointed to the guardianship to support "pulling the plug."  

Other family members then rushed in and said that dad was clearly not brain dead and was clearly responding to signs shown him.  Concerned honest hospital employees were tipping the family that the man was obviously not brain dead nor "vegetative".  That was what the hospital unsuccessfully attempted to portray in our subsequent court proceedings.  I didn't have to start a new law suit.  I was able to seek the restraining order using the the very same guardianship the hospital had tricked the family into obtaining.

After obtaining the emergency restraining order preventing a next day removal of life supports, I served it on the hospital.  We served it after business hours and upon the medical staff where the patient was housed.  Hospital personnel protested that only their legal department could receive the court order.  I said, "you are served, you are on notice."  The plug was not pulled and we had an emergency hearing.   At that hearing the Judge ordered that the man receive intravenous (IV) nutrients of which he had been deprived and a subsequent hearing was scheduled.  The hospital tried to prevent evidence collection.  Hospital attorneys sent both myself and the family warning letters telling them not to photograph nor videotape.  Of course, they did, securing evidence that he was responsive.  We then had a subsequent hearing and then the feeding tube was ordered.

The day of the ordered operation on the feeding tube, and while the Judge on the case would have gone to lunch, I received a telephone call from the hospital that the operation had been held, the patient put on an ambulance and transported to a facility in Sylvania, Ohio.  Clearly, moving him for the time being out of Michigan jurisdiction.  I was stunned at the audacity of that move.  That was the BAD NEWS.  The good news was that the hospital had moved him only 15 minutes from my medical expert, Dr. Paul Byrne of Sylvania, Ohio, then head of the Catholic Medical Association.  Dr. Byrne had done previous radio interviews with me on "passive euthanasia" issues.  On our next scheduled Court proceeding, that good Ohio doctor came as both an expert and fact witness.  Even more admirably, he came at his own expense from Ohio.  The hospital's staff attorney came confidently strutting into the Courtroom.  I made a motion that the hospital be dismissed from the case.  The patient was no longer a "guest in their facilities," I argued.  The judge asked the attorney why he should stay in the case.  "Because our medical records are involved," said the hospital's lawyer.  

The Judge roared:  "Medical records are involved in every case.  Out!"  She too was obviously disturbed  by the hospital's tactics.  During discovery, the hospital had long stalled on giving me access to the medical records of the patient.  Another lawyer, also a doctor, told me which medical records to ask for.  We asked for the EEG records.  The medical records people told me the EEG records were not there.  "And just where they?", I asked.  "They are stored in cardiology, the medical records person said.  "That's really interesting," I replied.  "Here are the EKG records.  This was the same night I took the deposition of the doctor determined to pull the plug.  The doctor pointed to alleged brain scan pictures and said "he hears nothing, he sees nothing, he knows nothing."

I had cross-examination fun on that one.  I repeated that statement to the doctor and asked if he really believed it to be true.  I then asked, "he is receiving Ativan (an anti-anxiety drug), is he not."  "Yes," the doctor said.   That is an anti-anxiety drug, is it not, I asked.  He cleared his throat and said, "yes, it's a tranquilizer."  Well, doctor, if he sees nothing, hears nothing, knows nothing, why would he need a tranquilizer?"  He cleared his throat and in his British accent, harrumphed, "well, I personally believe he needs nothing, but some of my colleagues are of a different mind."  He sat stony faced as we showed him the videos we obtained of this allegedly "brain dead" and/or "persistent vegetative state gentleman responding to family written messages.

Well, how does this relate.  I would have preferred my husband to to a separate hospital, but this hospital is highly regarded and promotes heavily in our area.  It now has a medical school attached.  It does have some excellent doctors.  It also had doctors such as the English doctor then on that case who I learned were attached to the British Eugenics movements.

All that was brought to me last night.  As we were driving home from the hospital, a call on my mobile phone told me my husband was discharged and we should pick him up and take him home.  I was astounded because my husband's condition was severe and something had caused his blood sugar to suddenly tank.  I told the caller that the situation smacked of medical malpractice.  Then, I trotted out in a heated discussion my attorney credentials and my long time knowledge that the hospital made "quality of life / triage type decisions."  A frail looking 82 year old bilateral amputee did not look like some body with a good quality of life.  Knowing my husband, his active and sharp mind and remarkable exploits in managing his disability, he has a life worthy of living as long as the Lord decides to keep him here.   I said many heated things and then the caller said, he would talk to the doctor and make a decision, but I should try to get him home that night.

Thank God, I didn't and couldn't.  During the night the same medical condition repeated despite food and nutrients being given.  I know I scared the hospital by threatening malpractice and raising my knowledge of the practice, but I know my husband is getting better care because of it.  I would not be at all surprised to receiving calls from hospital social workers asking me to sessions to explore "why we can't let go."  This lady is prepared for it.

Welcome to the New Age of Covid-Resets as are currently being promulgated by World Economic Forum and its leader Klaus Schwab.  A form of global trauma was deemed necessary for a reset and global governance launch.  At this time, I cannot definitively say that this is a "planned virus."  However, they are certainly not letting a good crisis go to waste.  The old New Age slogan as chortled by New Age author Marilyn Ferguson in her book AQUARIAN CONSPIRACY of "crisis = opportunity is happening.  A drastic lowering of the world's population, biodiversity, and thinning of the elderly were deemed welcome developments.

You are probably seeing things like this in your own medical institutions.  Sometimes, one just has to fight.  The nurse taking care of my husband seems conscientious.  But, I know there are institutional policies for less profitable patients and the inclination to dump a patient prematurely is happening.  

Anyway, that's one of the reasons you haven't heard too much from me lately.  I didn't name the facility in this story to "protect the guilty."  If my husband had been sent home last night, he would have died from the later developments in the night.  I have been given several horror stories of families where people were sent home from emergency and the need treatment not given.  We are grateful for good neighbors and that same facility's differing  medical people who intercepted the decision to prematurely discharge.  Pray for us as we go through this difficult stage of our senior years.

Here is the real world in a nutshell; ALL governments, if given the means and opportunity, will "interfere" wherever and whenever they can in order to advance the interests of their country, whether that interest is political, social or economic.

America is perhaps the worst when it comes to "interfering." Not only do we interfere in elections, we have literally overthrown duly elected governments and installed our own puppets in their place. If we can't depose a dictator that isn't "owned" by the US, the CIA will conduct a Coup. If that doesn't work, we'll find an excuse to go to war.

Does Israel interfere with OUR elections? Ever hear of AIPAC ? AIPAC is an extremely powerful lobby in Washington, DC, so much so, that politicians are terrified to oppose ANY foreign policy initiative put forth by Israel. Once in a great while, a politician has the guts to take a position that AIPAC opposes. What happens is this; AIPAC uses all its vast resources, including those in the media, to defeat that person in the next election. If that isn't election interference, I don't know what is.

Vicarius Christi (in place of Christ) is a title with which Roman Catholics have associated the Bishop of Rome, i.e., the Pope.


What does vicarious christi mean?

When Ireland voted on their referendum as to whether or not to make abortion legal, the Pope was ABSOLUTELY SILENT. The Vatican claimed that the Pope didn't want to interject himself into a "political matter" that must be decided by the people of Ireland !

Not wanting to be "political" never stopped the Pope from interfering with our "politics" when he stated that Trump "could not be a Christian" because he "believed in building walls" in order to keep ILLEGAL immigrants OUT of our country.

Except for “climate change is real”, this sounds like Trump. The president offered a path to citizenship for “Dreamers” in exchange for border wall funding, but was shot down by Democrats. Piper does not say who he'll vote for. I don't think he's voting at all. He provides condemnation for both sides.

Actually, this is a long-overdue article attempting to explain why I remain baffled that so many Christians consider the sins of unrepentant sexual immorality (porneia), unrepentant boastfulness (alazoneia), unrepentant vulgarity (aischrologia), unrepentant factiousness (dichostasiai), and the like, to be only toxic for our nation, while policies that endorse baby-killing, sex-switching, freedom-limiting, and socialistic overreach are viewed as deadly. The reason I put those Greek words in parentheses is to give a graphic reminder that these are sins mentioned in the New Testament. To be more specific, they are sins that destroy people. They are not just deadly. They are deadly forever. They lead to eternal destruction (2 Thessalonians 1:9). They destroy persons (Acts 12:20–23). And through persons, they destroy nations (Jeremiah 48:29–31, 42).

Therefore, Christians communicate a falsehood to unbelievers (who are also baffled!) when we act as if policies and laws that protect life and freedom are more precious than being a certain kind of person. The church is paying dearly, and will continue to pay, for our communicating this falsehood year after year. The justifications for ranking the destructive effects of persons below the destructive effects of policies ring hollow. I find it bewildering that Christians can be so sure that greater damage will be done by bad judges, bad laws, and bad policies than is being done by the culture-infecting spread of the gangrene of sinful self-exaltation, and boasting, and strife-stirring (eristikos).

I think Roe is an evil decision. I think Planned Parenthood is a code name for baby-killing and (historically at least) ethnic cleansing. And I think it is baffling and presumptuous to assume that pro-abortion policies kill more people than a culture-saturating, pro-self pride. When a leader models self-absorbed, self-exalting boastfulness, he models the most deadly behavior in the world. He points his nation to destruction. Destruction of more kinds than we can imagine. It is naive to think that a man can be effectively pro-life and manifest consistently the character traits that lead to death — temporal and eternal.

You may believe that there are kinds of support for such pathways that do not involve such a contradiction — such an undermining of authentic Christian witness. You must act on what you see. So, my questions to you are: (1) In 1959 were the same vineyards you reference in the link you supplied flourishing; i.e., was it warm enough in 1959 to support them? (2) Are there any current vineyards as far north as York?

In any case, whether the whole notion of grapes in England is erroneous, certainly, the information regarding Iceland and Greenland challenges the whole “climate change” narrative.

Just because climate in one particular cherry-picked area has varied naturally in the past or scientists in the past have made false climate predictions doesn't mean necessarily that what is happening and being studied now must be part of the same singular simple climate cycle, or equally errant. Nor do such fallacies mean McRaven is an idiot for believing in such or that his political views about Trump can also be discounted.

While I believe it's wise to be skeptical of bold and overstated predictions, particularly because we know God is Sovereign; but, it's not reason enough to dismiss the argument/premise that humans are having a negative effect on our environment. Christians should be leading the way to showing and being good stewards of our planet not shrinking from such responsibility simply because the Koch brothers and the dominionists have so muddied the waters.

Let's not abandon conservative principles entirely while trying desperately to prove Trump's not a racist. These weren't petty drug crimes.

Curtis McDonald (and Ms Johnson really) are not "victims" of a bi-partisan 1994 Crime Bill that sought, in part, to stop liberal judges from being too soft on crime. These two were in cahoots and working for Columbian drug traffickers and made their own very poor life-altering decisions back in the early 90's. Curtis, was not a child, he was 40 something years old. They were kingpin drug traffickers in Memphis raking in tens of millions of dollars. Sure they may be model inmates now and have earned clemency but their crimes were and are not "victimless". It's worth noting too that their crimes today would have resulted in a twenty-five year sentence due to changes resulting from Obama's 2010 Fair Sentencing Act. Not quite as harsh as "life in prison" but still reflective of the seriousness of their offenses.

Even Trumps US Attorney in Tennessee opposed releasing Curtis (when he was diagnosed with Covid):

U.S. Attorney Michael Dunavant, who apparently is still salty over Johnson’s release — last year, he denied her request to be released from federal supervision because, among other things, he believes she is gaining too much fame from telling her story — opposed McDonald’s plea for compassionate release in March.

On June 8, federal judge Samuel Mays Jr. (Bush Appointee) agreed with Dunavant, holding to strict interpretations of what comprises qualifications for such a release.

Also, if YOU were 'truly trying to follow Christ'... you would have followed Jesus and His 12 apostles in the Catholic faith that Jesus Christ Himself created in 33 AD... and not the 'spin off' religions (with their 'watered down' versions of the bible) which were started by MEN... as in disgruntled former Catholics (e.g. Martin Luther, King Henry VIII, etc.).

On Judgement Day, Jesus will be letting you know that, in fact, that 'does make it so'.

You might do yourself some justice by taking the time to read material that is outside of your domain. I've done this. For example, I've read the Catholic Catechism along with Thomas Aquinas's Summa Theologica. I've also read the Glories of Mary, etc.

You accuse me of "slander," a serious charge. By doing so, you also include all of the Reformers who also fervently believed that the Papacy was the very seat of the Antichrist.

Here is a FREE pdf download that is very well representative as to how and why the Reformers reached their conclusion. If you are firmly grounded in the truth, you should not fear to read alternative views. Prove that to yourself by reading this book:

Is Trump Why Migrant Children Are Still Not Reunited With Their Parents?

The mainstream media has nearly placed all blame on President Trump and his administration over reports that allege that its “zero tolerance” policy resulted in 545 migrant children not being able to reunite with their parents—a narrative that unfairly condemns the administration and fails to factor in the roles migrant parents and human smugglers have played in this situation.

In 2018, the Trump administration implemented the so-called “zero tolerance” policy at the southern border in an effort to deter illegal immigration and halt the endangerment of children who were being used by adults to gain entry to the country. The policy criminally prosecuted all migrants who entered into the country illegally. Prior to the Trump administration, most administrations did not criminally prosecute first-time illegal entrants. Because migrant children cannot be held in federal custody with adult migrants and detention of family units was limited to 20 days by a federal judge, there were only two bad options available: Either allow the flagrant abuse of our laws to continue, or separate children from adults. The policy was eventually scrapped a few months later.

Even though the “zero tolerance” policy has not been in effect in some two years, open borders lawyers and the mainstream media have charged the Trump administration with being responsible for 545 migrant children still not being able to find their parents...

The role of migrant parents in this situation has not been brought to light—and it should. According to Department of Homeland Security (DHS) Press Secretary Chase Jennings, “Out of the parents of 485 children whom Plaintiffs’ counsel has been able to contact, they’ve yet to identify a single family that wants their child reunited with them in their country of origin.” This likely suggests that the parents of these migrant children willingly separated from their child at the southern border in order for their child to obtain a better life in the United States. A 2019 Los Angeles Times piece further proves this theory where it reveals that “migrant parents stranded on [the]border send kids across alone.” Yet, there remains little to no blame on the parents for their decision making.

Additionally, the recent reports from the open borders lawyers and mainstream media fail to consider the responsibility that human smugglers play in this situation. Many migrant children are often sent to the U.S. border with human smugglers for a premium price. Once arrived at the border, the traffickers leave the children to be apprehended by immigration authorities—who typically quickly release children into the interior of the country due to laws that limit the amount of time unaccompanied minors can be detained. These smugglers may also pose falsely as the guardian of the child to gain easier access into the country. Regardless of what option the human trafficker may pursue, it still means that there is virtually little chance a migrant child can be reunited with a parent since these individuals aren’t their parents. Despite these known practices, human smugglers have not received any blame in this situation....

The Bible sanctioned marriage in the beginning. God married Adam and Eve in the garden and made two, one..male and female, created He them the Bible says right from the get-go as a mandate for humankind. He made sex for the marriage union and not for anything outside of that. Civil unions are secular but still not outside on what God established marriage to be..from the beginning.
Sex (in any type of thought and action) outside of marriage between a husband and his wife, is fornication. That is a sin in God's Book. Why is the Pope not for marriage as God said it is to be? He does not speak for God but for a political motive, or he would be backing God's stand on this.

Additionally, the "likely suggests" inference that the children were abandoned willfully by any of these desperate parents lightens the responsibility for such uncharitable and unChristian policies is absurd. Like my ancestors that immigrated here - they love their children and simply hoped for a better life for them.

Finally, the LA Times articles cited was from Nov 2019 (& the Atlantic article earlier in 2019). Both were discussing how desperate parents stuck on the Mexican side of boarder in migrant camps awaiting processing of their asylum applications under the subsequent follow-up ill-conceived Trump administration racist/xenophobic immigration policies of holding asylum seekers across the border were choosing to send their kids over the border alone (or with coyotes). These children are not part of the 545 being discussed in the court case and conflating these stories to lump these groups together is disengenious at best. A parent that "willfully" (yet in desperation) chooses to send their kid across the border with a coyote is tragic it isn't the same as parents and kids in handcuffs deliberately and completely unwillingly separated FOR YEARS by US Border agents upon the direction of executive orders signed by tribalist leader Trump.

Also, I don't have a 'mindless devotion to any 'institution'... but, YOU (and others on this blog) can not IGNORE the truth that Jesus Christ did create the Catholic Church in 33 AD. I mean you can continue to lie to yourselves... but, that doesn't change anything.

I am hardly lacking in 'courage'... as it takes a great deal of courage to come on to this blog over a period of 15 years. Whether I take a break of days, weeks or months (in between posting)... I can be ASSURED that when I do 'drop in'... there will be 'rants' against Catholics here. If that isn't obsessive behavior, I don't know what is.

Seated at his kitchen table, finishing off the remains of a Saturday breakfast, Hunter Hollingsworth’s world was rocked by footsteps on his front porch and pounding at the door, punctuated by an aggressive order: “Open up or we’ll kick the door down.”

Surrounded on all sides of his house, and the driveway blocked, Hollingsworth was the target of approximately 10 federal and state wildlife officials packing pistols, shotguns and rifles. And what was Hollingsworth’s crime? Drugs, armed robbery, assault, money laundering? Not quite.

Months prior, in 2018, the Tennessee landowner removed a game camera secretly strapped to a tree on his private land by wildlife officials in order to monitor his activity without apparent sanction or probable cause.

Repeat: Hollingsworth’s residence was searched by U.S. government and state officials, dressed to the nines in assault gear, seeking to regain possession of a trail camera—the precise camera they had surreptitiously placed on his private acreage after sneaking onto his property at night, loading the camera with active SD and SIM cards, and zip-tying the device roughly 10’ high up a tree—all without a warrant.

Can the government place cameras and monitoring equipment on a private citizen’s land at will, or conduct surveillance and stakeouts on private land, without probable cause or a search warrant?

Indeed, according to the U.S. Supreme Court’s (SCOTUS) interpretation of the Fourth Amendment.

The vast majority of Americans assume law enforcement needs a warrant to carry out surveillance, but for roughly a century, SCOTUS has ruled that private land—is not private. Fourth Amendment protections against “unreasonable searches and seizures” expressed in the Bill of Rights only apply to an individual’s immediate dwelling area, according to SCOTUS.

However, SCOTUS’ Open Fields doctrine has been bucked in Mississippi, Montana, New York, Oregon and Vermont through protections granted by state constitutions, and for many American landowners, the more they discover about Open Fields—the more questions they have regarding the bounds of government power.

In Tennessee, Hollingsworth and Terry Rainwaters, another landowner who discovered multiple trail cameras on his property placed by the state, are taking their cases to state court, claiming violations of the Tennessee State Constitution. The Rainwaters and Hollingsworth stories contain alarming claims regarding the behavior of wildlife officials and raise a bevy of questions over Open Fields, states’ rights, and the sanctity of private property.

Legal Stalking?

On bottomland squeezed in the rolling hills of northwest Tennessee’s Benton County, a short walk from the banks of the Big Sandy River, Terry Rainwaters, 53, owns 136 acres of land containing two homes, farmland and an equipment shed. Rainwaters and his son, Hunter Rainwaters, 20, live in one of the homes; a tenant occupies the other. The acreage is the physical center of Rainwaters’ life—a small place to farm, hunt and reside—with one way in, one way out, and a gate that stays locked, backed by “no trespassing” and “posted” signs.

On his way to hunt on his father’s land during the first week of December 2017, Hunter Rainwaters was driving a side-by-side through the property when he noticed an oddity positioned roughly 4’ off the ground. He popped the brakes, backed toward the object and looked in surprise at a trail camera belted to a tree.

“I didn’t see any words or stickers on it, but I knew right away it wasn’t ours,” Hunter Rainwaters recalls.

Following the hunt, he drove back onto the family property and spotted a second trail camera attached to a tree with several branches removed to allow for an unimpeded lens view. Rainwaters dialed his father’s cellphone, and described the two cameras: “I was shaken up when my son called and I knew immediately it had to be the TWRA (Tennessee Wildlife Resources Agency),” Rainwaters recalls.

Deeply disturbed, Rainwaters arrived home later in the afternoon and took a look at the two cameras, mulling over whether to remove the pair. Two days later, with Rainwaters in limbo on what action to take—both cameras disappeared.

“Ask TWRA how many cameras they have on people’s private land right now watching their every move,” Rainwaters says. “I’ll bet they won’t answer that question and we all know why. No warrants, no judge, and no crime necessary, just set up surveillance and do whatever they want to.”

(Farm Journal asked TWRA multiple questions related to the use of trail cameras in surveilling Tennessee residents, including, but not limited to: Does TWRA have a list of past camera locations and current, active cameras? Who in TWRA is allowed to view the footage? How long are the cameras allowed to operate in place? Does TWRA recommend prosecution for a landowner for breaking or removing a camera? TWRA declined comment: “The Agency cannot comment on matters in litigation, nor can we provide comment on issues that are currently being litigated.” TWRA directed all questions to the Tennessee Attorney General’s office. However, the Tennessee AG office declined comment.)

“The cameras were collecting pictures of us hunting, driving and just our lives,” he adds. “One of the cameras was even recording footage up to the back of my tenant’s house.”

Rainwaters contends he has encountered armed TWRA agents on his private property on multiple occasions, either crossing his land or hiding in undergrowth during hunting season. Rainwaters explains: “TWRA officers sneak onto my land with no cause other than hoping to find somebody doing something wrong. I’ve got a clean hunting record and don’t look for trouble with nobody, but people just can’t believe what has happened on my land. It’s so wrong on so many levels and way past outrageous and dangerous. I don’t think people realize a ‘no trespassing’ sign or ‘private land’ sign mean nothing to the TWRA.”

The alleged surveillance may have origins partially related to 2016 hunting violations, Rainwaters says, when his son and a group of friends were ticketed for baiting doves: “I paid their fines myself in what amounted to $380 times eight people. Yeah, all this started over hunting tickets and now TWRA thinks it’s OK to set up surveillance on my land.”

“Before all of this, we never realized what they are able to do on private land,” Rainwaters adds. “We’ve gotten so much response from people fired up over the TWRA, and most of them are like me, they’d never even heard of this ridiculous doctrine called Open Fields.”

Open Fields

Fourth Amendment protections against “unreasonable searches and seizures” expressed in the Bill of Rights only apply to an individual’s immediate dwelling and curtilage, according to SCOTUS. Curtilage is an arcane term loosely translated as the area directly around a home, or the yard.

In 1924, Hester v. United States set up the Open Fields framework and said the U.S. Constitution does not extend to most land: “the special protection accorded by the Fourth Amendment to the people in their ‘persons, houses, papers, and effects,’ is not extended to the open fields.” Significantly, Open Fields is translated beyond its literal sense, and basically is defined as general acreage: woods, fields, farmland, barren ground, and more.

Further, in 1984, SCOTUS gave additional strength to Open Fields in Oliver v. United States: “open fields do not provide the setting for those intimate activities that the Amendment is intended to shelter from government interference or surveillance. There is no societal interest in protecting the privacy of those activities, such as the cultivation of crops, that occur in open fields.”

“I’m surprised we haven’t already heard more about Open Fields,” says Stephen Mutnick, a criminal defense attorney with Winslow & McCurry, PLLC in Midlothian, Va. “For right now, landowners have to remember that Fourth Amendment protections only extend to the home, personal effects and the curtilage. If you post your property no trespassing, private citizens have to stay away, but that doesn’t apply to government officials who don’t even need probable cause.”

However, SCOTUS’ Open Fields doctrine has been bucked in Mississippi, Montana, New York, Oregon and Vermont through protections granted by state constitutions. The Institute for Justice (IJ), a national libertarian law firm and legal advocacy group representing clients pro bono, has taken on both the Rainwaters and Hollingsworth cases. Tennessee could become the first state in 20 years to reject Open Fields.

“We got involved (Terry Rainwaters and Hunter Hollingsworth v. TWRA; Ed Carter; and Kevin Hoofman) in both cases because we see an egregious abuse of property and privacy rights under the Tennessee Constitution, and an opportunity to show why the federal Open Fields doctrine is so misguided,” says IJ attorney Joshua Windham.

Windham insists private gates and “no trespassing” signs apply to government officials. “Otherwise the government is saying, ‘Your private land is my public property.’ Terry Rainwaters lives on his property, has a clean hunting record, yet he has to put up with wildlife officers hiding in bushes, ducking behind grass, and covertly recording his movements? By any definition, that is incredibly invasive,” Windham says.

“Everyone must keep in mind that the trail cameras were removed before Terry could take them down,” Windham continues. “That leaves at least two questions. One, how many pictures were taken? Two, how long were they going to keep taking them if Terry had never discovered the cameras?”

Windham’s questions rip the lid off a Pandora’s Box of additional queries. How often does TWRA place warrantless photo or video cameras on the land of state residents? Beyond the officer who places the camera, who else is in the know? Does TWRA have a list of past camera locations and current, active cameras? Who in government is allowed to view the footage? Who owns the footage? Is the government recording private/personal moments? Can the government film for days, weeks, years? Does TWRA recommend prosecution of a landowner for breaking or removing a camera? From both legal and ethical perspectives, the questions are extensive.


“Most people recognize that if the government can enter your land on a whim, and photograph you, or videotape you, without a warrant, that’s wrong on a basic level. But unfortunately, TWRA has been doing this for years and they’re still doing it today. What happened to Terry Rainwaters is not isolated—it’s widespread,” Windham says. “Look at Hunter Hollingsworth, for example. When people hear the details of what TWRA did on his land, they’re shocked.”

Secrets and Shadows

On ground that rubs the banks of the Big Sandy, roughly 5 miles as the crow flies from Terry Rainwaters’ farm, Hollingsworth owns 95 acres split between Henry and Benton counties. The acreage is remote, one road in and out, and gate access requires an easement access crossing two other landowners.

Approximately an hour before daylight on the morning of Jan. 26, 2018, Hollingsworth entered his property, intending to duck hunt, and as his truck rounded a curve, the headlights threw an unusual reflection high up a scrub oak—just enough light to spark Hollingsworth’s curiosity. Despite the likelihood of a raccoon or a forgotten piece of a rotting deer stand, he stopped the vehicle, walked toward the tree, and shined a flashlight up the trunk, illuminating the unexpected: a game camera and antenna zip-tied in place with the lens trained directly on his road and property.

Unnerved, Hollingsworth climbed into the tree, took note of several sawed limbs, cut the zip-ties, and removed the camera. Inside, he found an SD card for photo storage and a SIM card for message transmission.

“That camera had no markings on it, and it shook me up. I threw it in the truck and tried to go hunting, but all I could think of was how many more cameras were out there on my land. Hell, how could I have known right then, that months later, the Feds and TWRA would storm into my house and accuse me of stealing their property? Unreal, but it happened.”

The following afternoon, Hollingsworth accessed the memory card and found that over 1,000 photos of himself, family and friends (and TWRA officers entering his property) had been taken and transmitted. The earliest photos were dated Nov. 30, 2017, indicating the camera had been active for at least two months. The camera enabled round-the-clock monitoring of Hollingsworth, and TWRA was aware each time he entered or exited his land.

On the morning of Sept. 7, 2018, months after finding the camera, Hollingsworth was finishing breakfast when USFWS and TWRA officers surrounded his property and ordered to him to open the front door. “They were armed with all kind of guns, extra clips, first aid kits, and bulletproof vests—all to get the same game camera they snuck onto my land.”

(Farm Journal asked USFWS for comment on Hollingsworth v. TWRA and the search of Hollingsworth’s residence related to the game camera. In addition, Farm Journal asked for USFWS’ perspective on the Open Fields doctrine. USFWS declined comment on the entirety: “...we have no comment regarding this matter.”)

Hollingsworth was hit with hunting violations related to dove baiting, and also charged for theft of the trail camera in August 2019. Flatly stated, Hollingsworth believes the government was hunting a bullfrog with a shotgun. “I ended up with my first conviction for hunting over bait. I paid $5,000 for a lawyer and a $3,000 fine, lost my hunting license for three years, and missed a week of work. I’m not innocent of everything and I’m not above the law, but this was so heavy-handed and over the top, and I pleaded because I was in a headlock. They threatened me with jail time and hundreds of thousands of dollars in fines when in reality, I was railroaded over a camera.”

Ironically, the announced entry and search of Hollingsworth’s home required a warrant; the secret entry and hidden search of Hollingsworth’s private land required no warrant. The distinction is a capsule version of the Open Fields doctrine.

Hollingsworth filed a complaint (Hollingsworth v. TWRA) over the game camera in the U.S. District Court for the Western District of Tennessee Eastern Division, alleging violation of his constitutional rights, and on Oct. 21, 2019, Judge S. Thomas Anderson dismissed Hollingsworth’s suit, partially due to reliance on the Open Fields doctrine.

Bottom line, a federal judge told Hollingsworth he had no reasonable expectation of privacy on his farm, and that his Fourth Amendment rights were not violated by TWRA’s trespass and camera installation. Anderson wrote: “It follows that Defendants (TWRA) mounted the camera in what can only be described as ‘open field,’ an area beyond the scope of the Fourth Amendment’s protections. Without some particular allegation to show that Defendants conducted a warrantless search of his home or the curtilage of the home, Plaintiff has failed to allege a Fourth Amendment violation.”

Despite Anderson’s ruling, Hollingsworth is adamant: Secret surveillance is “gut-level” wrong. During the duration of the camera’s presence, he drove by it countless times and discovered the device by pure chance—a fluke. No matter how much time goes by, Hollingsworth can’t shake persistent questions about more cameras. “How many others were on my land? How many are there now? Why not movie cameras? Listening devices? They’re apparently allowed to do all this by the U.S. Constitution anytime they feel like it, so where does it end? They’re allowed to film wives, daughters, girlfriends in areas where privacy is assumed?"

“Let It All Hang Out”

Atop the pile of similarities shared between the Rainwaters and Hollingsworth cases, sits a benchmark factor: TWRA’s original trespasses had no warrant and no probable cause. Thus far, SCOTUS has excused such federal action under the Fourth Amendment, but IJ attorney Windham contends Open Fields is in direct conflict with the state constitution.

“The purpose of Article I, Section 7 of the Tennessee Constitution is to protect the right of people to be secure in their private property,” he says. “You are not secure in your property if state officers can enter your land, wander around, and record video footage of you and your private activities without a warrant. The same should also be true under the Fourth Amendment to the U.S. Constitution, but that’s a fight for another day.”

Again, under Open Fields, surveillance possibilities, particularly aided by digital technology, are increasingly invasive, and bound to expand as technological capabilities grow in tandem. Drones, live footage, powerful listening devices, virtual stakeouts and more were once the realm of sci-fi, but now must be reckoned as part of the Open Fields package.

“The Fourth Amendment is notoriously slow in catching up with technology,” says Mutnick, the attorney with Winslow & McCurry. He expects the Open Fields doctrine to gain more attention in the near-future, partially spurred by a rapid increase in surveillance tech. “Open Fields has basically been untouched by the Supreme Court since 1984, but think about the expanse of digital capability since the 1980s.”

Under Open Fields, any type of search on private land is legal, Windham says: “Any reasonable person out there recognizes the danger in allowing the government such power. The vast majority of us share a basic American understanding that private means private. We’re challenging TWRA’s initial entry of the properties and installation of the cameras, and there’s no evidence of a warrant for those searches. The positive news is that we have state constitutions. Even though TWRA thinks it has authority, we’re saying TWRA must follow the Tennessee Constitution and none of this is OK.”

Without accountability, the ability of a government official to monitor a private citizen, at will, is rife for abuse, Windham continues. “TWRA should have to get a warrant for these searches, plain and simple. You need an objective judge to consider each case and decide whether it makes sense for officers to enter private property. Otherwise, you have officers making decisions in the field, possibly based on their own subjective feelings or motivations, about when and how to search people’s private property.”

This is about the basic right of every Tennessean for privacy on their own property. Terry and Hunter are standing up for that right. As for Rainwaters and Hollingsworth, the pair is in agreement: The marriage of privacy and property rights is currently neglected by SCOTUS, but state constitutions must protect the union.

“I’m forced to assume I’m being watched on my land right now and it’s an awful feeling; just like the worst feeling in the world,” Rainwaters describes. “People hear the story and at first they can’t believe it’s happened, but I think the public should know about every detail of what their officials are doing in secret; let it all hang out for everyone to see.”

Hollingsworth echoes Rainwaters’ sentiments, and adds punctuation: “I’m so glad the Institute for Justice has helped us, otherwise we’d never have the resources to fight. This whole deal has made me so paranoid, and I find myself constantly checking for cameras or listening devices. Are we still in America? They get to put up secret cameras on our land and get live photos of what we’re doing, and that’s protected by the Constitution? There’s something fundamentally wrong with this whole picture.”

NOTE: Do you recall that in the beginning of the "mask hysteria," that the "scientists" were telling us that only N-95 masks were efficient in blocking out the virus and that ordinary dust masks would serve no purpose? (My personal take on this was that anything other than N-05, or better, would actually INCREASE your chances of infection due to the fact that, if the virus came in contact with your insufficient mask, it would live there, and you would continue to breath the virus into your system).

I strongly believe that this "crisis" is being used as a means of control that will be increased incrementally in the days ahead. The almost universal compliance with the face mask mandates is truly alarming.

In totalitarian societies, compliance with the State is everything. For example, in Nazi Germany, the common greeting was not "hello" but rather "Hiel Hitler." If a citizen did not return the greeting in like manner, they were often reported to the SS, as it was a sign of disloyalty. The same type of allegiance to the State was enforced during the French Revolution, whereby the wearing of the "Red Bonnet" (the Phrygian cap) was an outward sign of compliance with the Revolutionaries.)

Revealed: the full extent of Trump's 'meat cleaver' assault on US wilderness
After four years of Trump, protected places such as national monuments and wildlife refuges have opened to oil drilling, new maps show – with more on the way.

Clark Tenakhongva resides on the Hopi reservation in north-eastern Arizona, but his true home is a five-hour drive north in Utah, amid the rust-colored canyons and jutting buttes of Bears Ears, a beloved ancestral site of the Hopi people.

“For me, when I go there, it’s got its own place in my heart,” said Tenakhongva, the vice-chairman of the Hopi tribal council. “I feel like I’m back home.”

But after Donald Trump took office in 2017, Bears Ears was the focus of a sophisticated, pro-development pressure campaign.

What has happened at Bears Ears is not an exception. Under Donald Trump, the government has auctioned off millions of acres of public lands to the fossil fuel industry, the Guardian can reveal, in the most comprehensive accounting to date of how much public land the administration has handed over to oil and gas drillers over the past four years.

While the US government is supposed to be an impartial arbiter of how public lands should be used, Trump has stacked the administration with former fossil-fuel lobbyists and conservative activists. New research conducted by the Wilderness Society Action Fund, and shared with the Guardian, has found:

Of the more than 600m acres of US public land, the Trump administration has leased 5.4m acres – an area the size of New Jersey – to oil and gas companies.

Important side bar regarding Watergate: Nixon DID NOT ORDER the break-in. The break-in was orchestrated by career CIA & FBI operatives that went "rogue." The entire operation was conducted in such a baboonish, amateur manner that it appears the intent was to "get caught." Furthermore, Nixon had nothing to gain by the break-in. He was leading by double digits in every poll and went on to win 49 states. Nixon's "crime" was in the cover-up, for which he, in his words, "handed them a sword."

Not that it’s required but Sure I forget to use x a lot of times. But in addition to Craig’s astute observation that he, RayB and all monikered posters are really anonymous, id point out that even posters with monikers could make other posts as anonymous posts. If this were a moderated traditional forum, IP addresses could confirm things to an extent. More and more people use vpns and or post on their phone but I was retained to admin a large forum at one time and it’s usually pretty easy to figure out when someone is gaming the system. I have no idea if my IP is viewable to mrs Cumbey on this old system but if it is she can she confirm there is a lack of any inconsistency in my various posts other than several made on my phone (which I don’t prefer to do).

(I last posted saturday night late- my wife has a kidney stone and I’ve been at hospital or sleeping at home since). Hope to catch up at some point. Had some thoughts on Craig’s early Sunday response to me about immigration.
